TERMS AND CONDITIONS
THESE ARE THE TERMS AND CONDITIONS FOR THE USE OF THE AIRSIDE FACILITIES AT DURHAM TEES VALLEY AIRPORT. ALL PASSENGERS WISHING TO USE THE AIRSIDE FACILITIES AT DURHAM TEES VALLEY AIRPORT MUST COMPLY FULLY WITH THESE TERMS AND CONDITIONS. The FEE MUST BE PAID BY PURCHASING A PASS FROM THE MACHINES LOCATED IN THE AIRPORT, PRIOR TO THE FLIGHT AND MUST BE PRESENTED TO SECURITY.
1.0 Definitions and Interpretation
1.1 "Airport" means the entire Durham Tees Valley Airport, including but not limited to the airside facilities, the car parking facility, and all terminal buildings;
"Bye-Laws" mean the bye-laws which apply at the Airport copies of which may be obtained from the Legal Department at Durham Tees Valley Airport
"Conditions" mean these terms and conditions of use;
"Durham Tees Valley Airport" means Durham Tees Valley Airport Limited whose registered office is at Liverpool John Lennon Airport, Liverpool L241YD (registered number 0202043);
"Refund Request Form" means a form for use by a passenger wishing to claim a refund of the Passenger Facility Fee in accordance with clause 3.8 of these Conditions;
"Passenger" means You when you pay the Passenger Facility Fee.
"Passenger Facility Fee" means the fee payable for a Ticket;
"Ticket" means a valid ticket allowing a passenger access to the Airside Facilities in accordance with these terms and conditions;
"Variations" any change to these terms and conditions as notified by Durham Tees Valley Airport from time to time, and;
"VAT" means value added tax or any other tax of a similar nature and unless otherwise expressly stated all references to fees or other sums by Passenger are inclusive of VAT charged at the appropriate rate.
1.2 Words importing one gender include all other genders; words importing the singular include the plural and vice versa; words importing persons include a corporate body and partnership and vice versa.
1.3 Unless expressly stated to the contrary, and reference to a specific statute or to statutes generally includes any statutory extension or modification, amendment or re-enactment of it or them and any regulations or orders made under it or them.
2.0 Obligations
2.1 All Passengers who purchase and/or are holders of a Ticket are deemed to have accepted these Conditions which will form a legally binding contract between the passenger and the Airport. Passengers are admitted to the Airport Facilities strictly subject to these Conditions.
2.2 Access to the Airside Facilities will be granted at the sole discretion of the Airport and Passengers must conduct themselves in accordance with the Airports Bye-laws and the reasonable rules, requests and instructions of Durham Tees Valley Airport, its staff or subcontractors.
2.3 Durham Tees Valley reserved the right to amend these Conditions from time to time ("Variations") such amendments will be available on website or at the Airport upon request. [ www.dtvapff.co.uk]
2.4 Nothing in these Conditions will affect the statutory rights of any passenger using the Airport.
3.0 Ticket
3.1 Passengers may only access the Airside Facilities if they present a Ticket at the entry to the security checkpoint. A Ticket may only be used once.
3.2 The Airport reserves the right to refuse or condition access to the Airside Facilities from time to time and on a temporary or permanent basis. Accordingly, the Ticket does not guarantee access to the Airside Facilities or any other area of the Airport.
3.3 The Airport accepts no responsibility for lost, damaged or stolen Tickets. Passengers are responsible for the safety of their Ticket and lost, damaged or stolen Tickets must be replaced at the Passengers own cost.
3.4 Subject to clause 3.5 below the Airport will not be liable to any Passenger for any direct or indirect or consequential loss, damage, cost or expense incurred by that Passenger in the event that they are denied access to the Airside Facilities for any reason, including, but not limited to, their failure to present a valid Ticket.
3.5 Nothing in these Conditions will limit or exclude the Airport's liability in respect of death or personal injury caused by the negligence of the Airport nor shall anything in these Conditions limit or exclude liability of the Airport for any fraudulent act or omission.
3.6 A Ticket is non-transferable. They may not be transferred, sold, offered for re-sale or offered as a prize in any competition or promotional exercise with the written consent of the Airport.
3.7 A Ticket cannot be exchanged for monetary value.
3.8 The Airport will refund the Ticket where a Passenger's flight is cancelled in accordance with clause [5] below.
3.9 A Ticket will be valid on the date of travel and for the avoidance of doubt can only be used once to access the Airside Facilities.
4.0 Conduct of Passengers
4.1 The Airport reserves the right at any time and without prior notice to refuse admission to or expel any Passenger from the Airport who is in the reasonable opinion of Durham Tees Valley Airport, its staff or its sub-contractors:
4.1.1 has breached or is likely to breach these Conditions and any Variations;
4.1.2 has or is likely to commit an offence, breach the Bye-laws of this Airport or otherwise do anything that is unlawful; and
4.1.3 behaves or is likely to behave in a manner which endangers the health and/or safety of other passengers, staff or sub-contractors at the Airport.
4.1.4 banned from the Airport or any aircraft or if the Passenger is banned from travelling to a particular destination.
4.2 All Passengers must follow the reasonable instructions of the Airport's employees or authorised sub-contractors.
4.3 Any passenger who, in accordance with clause 3.2 and/or 4.1, is refused admission or is expelled from the Airside Facilities and/or the Airport will not be entitled to a refund of the Passenger Facility Fee.
5.0 Flight Cancellation and Refund of Passenger Facility Fee
5.1 Where subsequent to a Passenger purchasing a Ticket the passenger's flight is cancelled the passenger may claim a refund of an amount equal to the Passenger Facility Fee.
5.2 Where a Passenger wishes to claim a refund the Passenger should complete a Refund Request Form which can be obtained from the Airport Services Team Leader and should send it, with full details of the cancelled flight and the Ticket to Customer Services at Durham Tees Valley Airport
5.3 The liability of DTVA in the event of a cancellation is limited to refund the Passenger Facility Fee only and DTVA shall not in any way be otherwise liable to the Passenger.
6.0 General
6.1 No person, other than DTVA and a passenger who has paid the Passenger Facilities Fee, shall have the right to enforce the Conditions of this contract.
